Apple case against Samsung could go back to lower court

The U.S. Department of Justice asked the Supreme Court to overturn an appeals court ruling that had favored Apple Inc over Samsung Electronics Co Ltd in smartphone patent litigation, and asked that it return the case to the trial court for more litigation.

Samsung are thieving scumbags and should pay. Period.

  1. It’s somehow not unexpected that the US Dept. of Justice (hahahahaha) supports a Korean company against Apple. I’m not sure whose bread is being buttered in the Justice Dept., but a clear pattern is emerging… first, the book publisher’s antitrust bullshit, the Feeb’s non-postal workers shooting up the office Christmas party (TERROR!) excuse for invading everyone’s privacy, and now this. (I’m sure there are more examples.) Whether it’s Apple’s reluctance to play the DC game or some other reason, the DOJ has a clear hard-on for Apple.

    Is this what we pay taxes for?

  2. This is insane. Does Apple get away with this kind of BS too, and I just don’t know about it? I still think they should have gotten triple damages on the basis of that lengthy point-by-point comparison the Samsung engineers did, comparing all their UI details to iPhone and then changing to match. If that’s not the very definition of intentional, what is?

  4. Do your homework. Study history. This happens to many large companies. Stop wasting time feeling sorry for Apple. They are doing just fine.

  5. The issue at hand is if Apple should get 100% of the profits even though the profits due to those patents are a small portion of overall patents. This would be akin to Apple having to give 100% of their iPhone profits to the University of Wisconsin for the patents related to the A7, A8 and A8X patents. If this level of damages ends up being precedent, Apple is far more likely to be harmed in the future rather than helped.

  6. Yes. The WARF case. Apple was only ordered to pay WARF $2.34 per device as opposed to 100% of profits on the devices.

  7. I’m sorry, but “WARF”? I don’t know which case you’re talking about, but I’m willing to bet that no court every granted a judgement against Apple that said the plaintiff was entitled to 100% of iPhone profits, so you’re confusing the topic. What the plaintiff asked for and what a ostensibly sober and responsible judge ruled are two entirely different things. This is a situation where Samsung went to trial, lost, got off lightly (in that they were given a free pass on what was obviously a purposeful and willful act), and have gone to court again and again and again and again to contest every tiniest aspect of the case, and whittle away at the judgment.
