Apple loses appeal in UK court

The US firm had previously been ordered to place a notice to that effect – with a link to the original judgement – on its website and place other adverts in the Daily Mail, Financial Times, T3 Magazine and other publications to “correct the damaging impression” that Samsung was a copycat. The appeal judges decided not to overturn the decision on the basis that a related Apple design-rights battle in the German courts risked causing confusion in consumers’ minds.

    I have a hard time taking this seriously. It is almost as if school children held court and made up these punishments. What an unprofessional and embarrassing display of the judicial system in the UK. Is it really de-rigueur in the UK to have one multi-billion dollar company be forced by court order to appologize to another multi-billion dollar company? That seems so bush-league

    Apple could turn this into a positive. I can see their ad now:

    “At Apple, we felt it necessary to protect our intellectual property, and felt Samsung’s products copied our property. But we were mistaken. The UK Court has determined that the Samsung product is not close to being as cool, elegant, or easy to use as the iPad”

    The only good than can come out of this is to have Jim or the Macalope or MG Siegler (or all 3) write the the statement to be published.

    I think those judges had too much warm beer for lunch to come up with that decision.

    To be fair our IP law is very tough to get rulings for either side. In fact it’s some of the toughest IP law in the world.

    I wouldn’t be surprised if Apple refused to post the apology though and takes the fight to the EU.
